ACEC Listserv Rules & Legal Notice
Thank you for being part of our Listserv community. The Listserv is a great way to solicit the advice of your peers, benefit from their experience, and participate in an ongoing conversation. To ensure the best possible experience for all Listserv participants, we have established some basic Listserv rules for participation (please see below).
By joining and using one or more of the ACEC Listservs, you agree that you have read and will comply with the following rules. You also agree to abide by ACEC’s Antitrust Policy, which you can read here, and all other relevant policies and procedures of ACEC. You also agree to limit Listserv discussions to topics best suited to the medium.
Listserv Rules
- Do not discuss or make agreements on prices, salaries, fees, specific business transactions, allocation of markets, or the boycotting of any person or company. Discussions of benefits that could reasonably be perceived to lead to agreements between Listserv participants as setting healthcare policy or other specific benefits should be avoided. See the Legal Notice below for further information.
- Do not post commercial messages advertising products or professional services on any Listserv. Contact people directly, not through the Listserv, with product and service information if you believe it would help them. Requests for professional referrals are permitted for posting, and responses may likewise be sent through the Listserv subject to these rules. ACEC reserves the right to post information concerning ACEC educational products and programs to any Listserv for the benefit of its participants.
- Do not defame, disparage, or criticize any person or company. All defamatory, abusive, profane, threatening, offensive, or illegal materials are strictly prohibited. Do not post anything in a Listserv message that you would not want the world to see or that you would not want anyone to know came from you.
- Do not challenge or attack others. The discussions on the Listservs are meant to stimulate conversation, not to create contention. Let others have their say, just as you may.
- Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that he or she owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants ACEC and users of this list the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.
- Send your message only to the most appropriate Listserv(s). Do not spam several Listservs with the same message.
- Use caution when discussing products or services. Information posted on the Listservs is available for all to see, and comments are subject to libel, slander, and antitrust laws.
- Remember that ACEC and other Listserv participants have the right to reproduce postings to this Listserv.
Please take a moment to acquaint yourself with these important rules. In order to preserve a climate that encourages both civil and fruitful dialogue, ACEC reserves the right, as noted below, to suspend or terminate access to all Listservs for participants who violate these rules.

This Listserv is provided as a service of ACEC. ACEC is not responsible for the opinions and information posted on this Listserv or the ACEC website by others. ACEC disclaims all warranties with regard to information posted on this Listserv or the ACEC website, whether posted by ACEC or any third party; this disclaimer includes all implied warranties of merchantability and fitness. In no event shall ACEC be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, arising out of or in connection with the use or performance of any information posted on this Listserv or the ACEC website.
Messages should not be posted if they encourage or facilitate members to arrive at any agreement that either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct intended to illegally restrict free trade. Messages that encourage or facilitate an agreement about the following subjects are inappropriate: prices, discounts, or terms or conditions of sale; salaries; benefits; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers.
ACEC does not actively monitor the site for inappropriate postings and does not on its own undertake editorial control of postings. However, in the event that any inappropriate posting is brought to the attention of ACEC, then ACEC will take all appropriate actions. ACEC reserves the right to terminate access to any user who does not abide by the Listserv Rules.
