House Passes ACEC-Supported Bill To Curb "Junk" Lawsuits

The House passed legislation this week that seeks to curb so-called "junk" lawsuits, part of a continuing legal reform agenda advocated by ACEC and other business organizations.
Introduced by Rep. Lamar Smith (R-TX), the Lawsuit Abuse Reduction Act (H.R. 420) would establish mandatory sanctions for filing frivolous lawsuits in violation of Rule 11 of the Federal Rules of Civil Procedure.
The Act would abolish Rule 11's current "free pass" that allows lawyers to avoid sanctions by simply withdrawing frivolous claims within 21 days after a motion for sanctions has been filed.
Additionally, a "Three Strikes and You're Out" provision mandates a one-year suspension of a law license to practice in a federal court after a lawyer has filed three or more lawsuits deemed frivolous in the same federal court.
ACEC is urging Congress to pursue a broader tort reform agenda that includes asbestos liability reform, liability caps to control health care costs, and Good Samaritan protections. |

ACEC Business Insurance Trust Announces Enhancements to Program
In an ongoing effort to make the ACEC Business Insurance Program more attractive to ACEC member firms, the Business Insurance Trust has announced three new policy amendments that will enhance the program's benefits.
The policy amendments were designed by the Trust in cooperation with Marsh USA Inc. and The Hartford Insurance Companies, and are available as part of the Spectrum product covering Property and Business Liability. They are:
- Engineers' StretchDesigned generally for small firms, adds new coverage for "Billable Hours" if business income and extra expense are covered under the policy.
- Superstretch for EngineersDesigned generally for mid-size to larger firms, also adds new coverage for "Billable Hours" if business income and extra expense are covered under the policy.
- Consulting Engineers' Property CoverageIncludes coverage for equipment taken to job sites.
The new amendments have been designed especially for ACEC members participating in the ACEC Business Insurance Program, and replace the current "Extension of Coverage for Engineers" and "Tri-Ad" coverages.
Existing customers of the ACEC program will automatically have equivalent or better coverage at renewal when these new enhancements replace the existing ACEC amendments, subject to approval in each state. Marsh and the Trust negotiated very competitive premium charges for the improved protection included in these policy enhancements.

Prudential Retirement GoalmakerSM Program Offers Aid In Constructing 401K Portfolios
Prudential Retirement, the record keeper for the ACEC Retirement Trust, is offering assistance to participants in the building of investment portfolios through a program called GoalmakerSM.
GoalMakerSM shapes a portfolio based on your investment personality, which is based on your tolerance for risk and your time horizon until retirement. Participants complete a questionnaire to determine these factors and then select one of 12 predetermined investment portfolios.
The GoalMakerSM program includes an automatic rebalancing feature to maintain your original investment objectives over time, and will soon offer an automatic age migration feature so that you can elect to have your investment elections change as your expected retirement date draws nearer.
