Highway Trust Fund Shortfall Projected;
ACEC To Identify Solvency Options

Experts testifying before a House subcommittee last week indicated that the balance in the Highway Account of the Highway Trust Fund is expected to drop below levels authorized in the final year of SAFETEA LU, resulting in significant reductions in highway funding to the states.

The hearing before the House Highways, Transit and Pipelines Subcommittee focused on how government agencies track future tax receipts into the Highway Trust Fund.

The U.S. Department of the Treasury has found in its latest projections that the Highway Account of the Trust Fund will have a $2.3 billion negative balance in F.Y. 2009, the last year of SAFETEA LU. The Transit Account is projected to have a $6.9 billion positive balance. The Congressional Budget Office (CBO) used different economic assumptions that show a slight positive balance in the Trust Fund in F.Y. 2009.

CBO and Treasury Department officials said that the different projections were normal and fell within an acceptable margin of error. But both agreed that insolvency was imminent, either in F.Y. 2009 or F.Y. 2010, unless Congress acts.

Should the Highway Account run a negative balance in F.Y. 2009, panelists offered several options for Congress, including cutting back highway spending from the amounts designated in SAFETEA LU, or transferring funding from the Transit Account to highways. Subcommittee Chairman Tom Petri (R-WI) noted that if Congress indexed the gas tax since its inception in 1956, the tax would be 25 cents rather than the current 18.3 cent tax.

ACEC is working with AASHTO and other industry allies to focus congressional attention on this issue, and the ACEC Transportation Committee is set to examine the existing federal revenue system and identify financing options to meet future infrastructure needs.

"The solvency of the Highway Trust Fund represents a looming threat," ACEC President Dave Raymond said. "Congress cannot wait until the next highway bill to solve the problem—they need to act now, which is the message that ACEC members will be taking to Capitol Hill during the upcoming Annual Convention and Legislative Summit."

ACEC Set To Launch New Liability Insurance Survey Of Member Firms

ACEC's Professional Liability Insurance Survey of member firms for fiscal year 2005 will be conducted online beginning next week through April 28.

This annual survey collects information on member firms' professional liability insurance, their claims experience, and the impact of the threat of litigation.

An email with a link to the survey will be sent on April 17 to the key contacts of the member firms.

"This information is crucial to determining the professional liability insurance landscape which our members must deal with, and it provides important information for our tort reform efforts in Congress," said Chuck Kopplin, chairman of the ACEC Risk Management Committee. "I strongly encourage each member firm's headquarters office to participate in the survey."

The results of the survey will be published in Last Word, with a more detailed article to follow in the July/August 2006 issue of Engineering Inc.

ACEC Business Insurance Trust Unveils New Website; Adds Identity Theft Coverage

The ACEC Business Insurance Trust (BIT), provider of business and professional liability insurance to ACEC member firms, has unveiled a new and improved website.

The new site, www.acecbit.com, includes several user-friendly enhancements such as interactive video; vehicle and location change requests; simplified certificate of insurance ordering; a loss-control library; and "Meet the Trust" and "Meet the Marsh Team" (the program administrator) pages.

The BIT also announced that its underwriter, The Hartford, has added Identity Recovery Coverage as part of the core product offering to BIT program participants in most states. Identity theft is the fastest-growing crime in America, with nearly 10 million victims in 2002, according to the Federal Trade Commission. On average, it takes victims of identity fraud some 60 hours and $1,200 to correct the problem; in many cases, the cost is much higher.
