ACEC/Illinois Passes Landmark QBS Legislation

The Illinois legislature has cleared an ACEC/Illinois-backed measure that will reinforce the application of QBS among local governments.

The QBS legislation, which now awaits the signature of Governor Rod Blagojevich, effectively reinstates a QBS requirement for local governments that was overturned by a recent state court decision.

"This is a tremendous victory," said ACEC/Illinois Executive Director David Kennedy. "Our members did a superb job in lobbying the legislature, and we succeeded in putting together a strong coalition of other design professional and contractor groups, as well as state and local agencies to help us."

The College of DuPage argued in a lawsuit that it was allowed to ask for pricing information from engineering firms because the local QBS law did not specifically prohibit them from doing so.

The court sided with the college, prompting ACEC/Illinois to pursue new legislation to clarify the scope of the law to apply to local governments and state-supported institutions of higher learning. The legislation was pushed through during a special, six-day veto session, and received overwhelming, bipartisan support.

House Clears ACEC-backed Water Reuse Bill

The House of Representatives passed water reuse legislation this week, just prior to adjournment for the year.

The More Water and More Energy Act of 2006 (H.R. 5110), sponsored by Congressman Mark Udall (D-CO), enables the reuse of water produced during the extraction of oil or natural gas resources. This "produced" water can be reused beneficially in agricultural and industrial applications.

ACEC Environment & Energy Committee member, David Stewart of Stewart Environmental Consultants, Inc. in Fort Collins, Colorado testified in support of the legislation during House Resources Committee hearings in September.

While the Senate is not expected to act on the measure prior to adjournment, the broad, bipartisan support for the bill is an indication that it may receive quick approval in the new Congress in 2007.

Final Passage Of Key Spending Bills Put Off Until 2007

The House and Senate passed a "continuing resolution" this week that will keep key federal transportation, environmental, and other federal construction programs funded through February of 2007.

While House and Senate Democrats take over the leadership of both institutions in January, negotiations will continue over the holidays to reach final agreement on the spending bills for the coming year.

Final passage of the F.Y. '07 Transportation-Treasury appropriations bill is particularly critical. The authorized $3.5 billion funding increase for state departments of transportation under SAFETEA LU cannot go forward without the final appropriations bill signed into law.

ACEC has alerted the incoming Speaker of the House, Rep. Nancy Pelosi (D-CA), of the need to finish the appropriations bills early in 2007. The Council will be working with its industry allies over the next several weeks to accomplish this goal, and to lay the groundwork for the next round of spending bills for 2008.
