ACEC Member Action Needed On Water Infrastructure Funding LegislationNow!
ACEC members are encouraged to contact their House members to advance passage of H.R. 720, the Water Quality Financing Act of 2007. The measure was approved by a House committee last month, and could go to the House floor for a vote next week.

After undergoing a modification to address budget rules and issues, the bill that is set to go to the House floor authorizes $14 billion over four years (compared to the previous $20 billion over five years) to fund wastewater projects under the Clean Water State Revolving Fund (SRF) program, including a $1 billion increase over the F.Y. 2007 level. It also contains a provision requiring the use of Qualifications-Based Selection (QBS) for projects funded under the bill.
The legislation also requires the General Accountability Office (GAO) to report back to Congress by January 1, 2008 on "funding mechanisms and funding sources available to establish a Clean Water Trust Fund." The language helps set the stage for future congressional action on establishing a long-term source for water infrastructure funding.
Reports by the U.S. Environmental Protection Agency, the GAO, and the Water Infrastructure Network (WIN) all show a water infrastructure funding gap of between $300 billion and $500 billion over the next 20 years. |

ACEC-Backed Legislation to Repeal 3 Percent Withholding Introduced In the House

Legislation to repeal an onerous tax withholding requirement for all government contracts and payments was introduced in the House this week by Congressmen Kendrick Meek (D-FL) and Wally Herger (R-CA).
The Meek/Herger bill (H.R. 1023) would repeal Section 511 of the Tax Increase Prevention and Reconciliation Act of 2005, which is a sweeping new requirement mandating that federal, state and local governments that spend $100 million or more annually withhold 3 percent from payments for goods and services.
The withholding mandate is scheduled to take effect in 2011 and covers all government contracts as well as any payment to any person for a service or product provided to a government entity.

"This is one of the most inherently unfair pieces of legislation to come along and we will aggressively fight to see that it is killed," said ACEC President Dave Raymond.
ACEC is working with a broad coalition and actively lobbying Congress to pass the real bill. Passage of this legislation will also be a major goal for ACEC's "citizen lobbyists" during the Annual Convention in Washington, D.C.
