Big Dig Settlement: $458 Million

The joint-venture of Bechtel/Parsons Brinckerhoff which oversaw design and construction of the nation's largest public works project—Boston's Central Artery/Tunnel, also known as the "Big Dig"—has agreed to pay $407 million to settle a state lawsuit stemming from leaks, a fatal ceiling collapse and other design flaws that have plagued the project.

Parsons Brinckerhoff will contribute $47.2 million toward the joint-venture's portion of the settlement.

Several smaller companies will pay some $51 million as part of the overall settlement.

Bechtel/Parsons Brinckerhoff will not face criminal charges, but the settlement allows authorities to seek additional damages from the consortium in the event of a major future failure in the project causing more than $50 million in damage.

The majority of the $458 million will be held in a new state trust fund to provide for future non-routine repairs and maintenance of the Big Dig.

ACEC/Massachusetts Executive Director Abbie Goodman said: "ACEC/Massachusetts and its member firms are pleased that a settlement has been reached with the Commonwealth.

"We have been actively and cooperatively working for a settlement of the issues related to the project for several years and continually advocated a single, fair, fact-based cost recovery settlement process with finality that was approved by both federal and state authorities."

The $14.79 billion Big Dig project replaced the old elevated Central Artery that ran through the heart of Boston with a series of underground tunnels, ramps, and a new bridge.

ACEC/Delaware Delivers Support For Senator Thomas Carper

ACEC/Delaware leadership presented a PAC check recently to Senator Thomas Carper (D-Delaware) to help the lawmaker's re-election bid.

Senator Carper met with ACEC/Delaware officials to discuss his support of Science and Technology Education Partnership (STEP) legislation, his ideas for economic stimulus packages including the recently passed WRDA bill, and funding for transportation.

As deputy whip, Carper sits on the Senate Homeland Security and Governmental Affairs Committee, the Banking, Housing and Urban Affairs Committee, and the Environment and Public Works Committee.

Chinese Engineering Association Seeks ACEC Educational Assistance

Representatives of the Chinese National Association of Engineering Consultants (CNAEC) visited ACEC headquarters last week to seek educational program assistance.

Under a proposed arrangement, ACEC will conduct educational seminars for delegations of Chinese engineers visiting the U.S.

"In China, ACEC is recognized as the most affective organization for developing valuable educational seminars for engineers," said CNAEC Director Tang Ping. "We are looking forward to utilizing ACEC's expertise to assist our members with running their businesses in China."


Member Feedback Needed On GPS Machine Guidance Contract Language

The use of GPS "Machine Guidance" is growing rapidly in construction applications involving motor graders, dozers, excavators, trimmers, profilers, compactors, and asphalt and concrete pavers.

Use of this technology has created several issues that affect the engineering and surveying industry, including "what is the appropriate contract language needed to avoid costly litigation in a legal dispute regarding a firm's use of the technology," according to Edward Garrigan, chairman-elect of the Council of Professional Surveyors (COPS).

Additionally, having such language "can establish the activities a firm will conduct during construction and how the firm is to be compensated," he said.

COPS has proposed language for firms to use to help avoid costly fees resulting from unwarranted lawsuits and to clarify the activities and responsibilities of the engineer and land surveyor during construction.

This includes a position statement on this issue along with suggested language for plans and contracts. COPS leadership is requesting that all ACEC member firms interested in this subject to click here to visit the COPS web page and to offer comments to improve the language.

ACEC has unveiled a valuable new online resource for one-stop purchase of the important contracts and forms needed in day-to-day operations by design and construction firms.

The new "Contracts Central" web page is accessible through the ACEC Bookstore or by clicking here.

"Contracts Central" brings together a complete inventory of contract forms and supporting documents used by over 500,000 A/E professionals delivering facilities and civil infrastructure for public and private owners.

Following are six essential documents every firm needs.

  • EJCDC E-500 Owner/Engineer Agreement—Use this document to cover the key phases of services provided by the engineer to the owner: study and report, preliminary design, final design, bidding and negotiating, construction, and operation.

  • EJCDC E-520 Owner/Engineer Agreement, Short Form—For projects of limited scope and complexity, which do not require the level of detail provided in E-500, the full version of Agreement between Owner and Engineer.

  • EJCDC E-505 Owner/Engineer Agreement Task Order Edition—This document is designed for owners and engineering firms that wish to contract for work on a series of yet unspecified projects.

  • EJCDC C-700 Standard General Conditions—This document is between the owner and contractor and explains in detail the status of the engineer during construction. It is the most widely used and accepted of all engineering documents.

  • EJCDC C-800 Guide to the Preparation of Supplemental Conditions—All contracts will need to be modified. This is the form to be used to modify and make C-700 General Conditions fit a particular project.

  • A Guideline Addressing Coordination and Completeness of Structural Construction Documents—This document will help everyone in the building design and construction process. It focuses on the degree of completeness necessary in the construction documents to achieve a "successfully completed project." It is a framework for a quality management process and includes a Drawing Review Checklist.
