| House Infrastructure Leaders To Join 1,000-plus At ACEC Annual Convention

Both the chairman of the House Highways and Transit Subcommittee and the House member leading the charge to increase investment in water infrastructure, will brief ACEC members prior to their Capitol Hill lobbying effort at ACEC's Annual Convention, April 27-30, in Washington, D.C.
More than 1,000 members have already registered for the Convention"another sell-out crowd," according to ACEC Meetings Director Leslie Zeck.
Rep. Peter DeFazio (D-OR), who chairs the transportation panel, will discuss problems facing the Highway Trust Fund and potential solutions. He will be joined by Rep. Earl Blumenauer (D-OR), who has been working with ACEC to develop new approaches to funding water projects. Blumenauer is planning to introduce federal legislation this year to create a dedicated trust fund to help communities address water needs.

Funding for transportation and water are two critical lobbying objectives that ACEC members will take to Capitol Hill, in addition to repealing the new 3 percent withholding mandate that will impact virtually every firm.

| Kentucky Third To Meet 2008 ACEC/PAC GoalElection Year Means "A Lot" At Stake

ACEC/Kentucky became the third Member Organization to reach its 2008 ACEC/PAC fundraising goal, joining Wisconsin and Tennessee.
The Bluegrass State was propelled by strong support from several Millennium Club and Chairman's Club members, as well as two members of the new $5,000 Capitol ClubStephen Scott and Craig Avery, both from Stantec.
"We're happy we met our goal, but we're not done yet," said Kentucky ACEC/PAC Champion Ron Gilkerson of GRW Engineers Inc., in Lexington. "Last year, we more than doubled our ACEC/PAC goal, and I see no reason why we can't finish 2008 just as strong. This is a congressional election year, and there is a lot going on right now on Capitol Hill that directly impacts all of us."
ACEC/PAC Champions representing each Member Organization have set a national fundraising goal of $800,000 for 2008. Each state has been assigned a specific fundraising target based on membership strength.

ACEC Gains House Committee Delay On 3 Percent Withholding Implementation
The House Ways and Means Committee once again signaled its concern over a new 3 percent withholding mandate this week when it approved ACEC-supported legislation to further delay its implementation.
Among other provisions, the Taxpayer Assistance and Simplification Act would push the implementation of the 3 percent withholding mandate from 2011 to 2012. The measure also requires the Treasury Department to study the cost impact to governments and businesses that would result from the new requirement.
The bill is very similar to legislation passed by the House last year, where ACEC and its industry allies have built up a strong bipartisan base of support for repealing the mandate. The effort remains stalled in the Senate, however, in the face of opposition from Senate Finance Committee Chairman Max Baucus (D-MT) and Ranking Member Charles Grassley (R-IA).
Lobbying the Senate for repeal of the 3 percent withholding mandate is a top priority for ACEC's lobbying effort during the Annual Convention.

| North Carolina Scores Major Judicial Victory
ACEC/North Carolina won a major Court of Appeals decision last week which upheld a limitation of liability clause in a design professional's contract with a client.
In the case of Blaylock Grading Company v. Smith, the Court reversed a lower court decision that had found the clause to be against public policy. The limitation of liability clause limited the damages payable by the design professional to a predetermined amount.
ACEC, ACEC/North Carolina, and the state chapters of NSPE and the AIA participated in an amicus brief defending the clause. ACEC also provided input in the planning stages of the joint amicus brief effort.
ACEC/North Carolina Executive Director Kathryn Sawyer said: "This is an important legal victory for the state and the engineering industry that would not have been achieved without the help of ACEC."

ACEC/Maryland and ACEC/PAC sponsored a fundraiser this week for Rep. C.A. "Dutch" Ruppersberger (D-MD)a member of the House Appropriations Committee and a solid supporter of federal funding for infrastructure projects.
ACEC/Maryland Executive Director Jim Otradovec said the event was a natural fit for his members: "Many of our members knew Congressman Ruppersberger when he served as the Baltimore County Executive. He's always been very sensitive to engineering concerns, and he's especially aware of the need to build and maintain our roads, bridges, airports and public facilities."
The Maryland lawmaker is in his third term in the House of Representatives, serving on the committee that sets yearly funding levels for key federal programs, including transportation, water projects, energy infrastructure, and public buildings.

| HDR Leader Charles Durham Dies at 90

Charles Durham, who is the "D" in HDR, and who helped build the Omaha-based company into one of the nation's largest engineering firms, died April 5. He was 90.
Durham is credited with helping establish the strong governmental affairs function at ACEC, including the subsequent creation of ACEC/PAC.
Over three decades, Durham built HDR from 15 employees working on Nebraska projects to 1,700, with offices in 20 cities, working on projects in all 50 states and 20 countries.
"Chuck Durham left a legacy that all of us should take great pride in," said HDR Chairman and CEO Richard R. Bell.
Richard Corrigan, ACEC vice chairman who worked with Durham as one ACEC's first Governmental Affairs directors said, "Chuck was one of those larger than life figures who contributed much to ACEC and our industry."
