| Obama Win, Expanded Democrat Majorities, Spell Opportunities and Challenges

ACEC anticipates that the administration of incoming President Barack Obama, combined with expanded Democratic majorities in the House and Senate, will give new momentum to ACEC efforts to boost transportation and water infrastructure funding in 2009.
At the same time, a resurgent labor agenda—including curbs on contracting out, legislation designed to pressure employees to unionize, and costly health care and tax code changes—could pose threats to the industry.
"We will move aggressively in 2009 to push our agenda," said ACEC President Dave Raymond. "While challenges will no doubt emerge, I see a real opportunity to work with the new President and the new Congress to address the serious backlog of infrastructure needs facing the country."
ACEC's staff has already been in touch with the Obama transition policy staff to convey industry priorities and maintain contact going forward.
While several Senate races have yet to be decided, Democrats will control at least 56 seats, against 44 Republican seats. Several undecided races remain in the House, but Democrats will have at least 225 seats, for a net gain of at least 19 seats. Republicans will have about 180 seats, depending on final totals and possible recounts.

| Strong Win Rate For ACEC/PAC On Election Night
ACEC/PAC enjoyed a strong victory margin on Election night, with 95 percent of the Democrats and Republicans backed by the Council either winning re-election or winning open seat contests.
Overall, ACEC/PAC contributed nearly $1 million to pro-business Senate and House candidates during this election cycle, a new record and a key indicator of the growth in the Council's political program.
Most of ACEC's congressional friends will be returning to Congress, as well as several new members who have worked closely with ACEC state organizations on industry issues.
One notable example is Illinois State Senator Debbie Halverson, a Democrat who won a hotly contested open congressional seat. "This is a big win for ACEC and our members in Illinois," said ACEC/IL Executive Director Dave Kennedy. "Debbie was the first woman in the state to be elevated to the position of Senate Majority Leader, and we've worked closely with her over the years."
ACEC also backed Ohio State Senator Steve Stivers, a Republican who appears to have won the open seat in Ohio's 15th congressional district, pending a recount.
"We knew Steve well at the state level and he was very supportive of our issues," said ACEC/OH Executive Director Donald Mader.
"One of the key lessons from the presidential and congressional contests was the critical need to raise the resources necessary to win," said ACEC President Dave Raymond. "This has important implications for continuing to build our PAC."

Oregon And Hawaii Top 2008 ACEC/PAC Goal

Oregon and Hawaii became the thirteenth and fourteenth Member Organizations to meet their 2008 ACEC/PAC goals, joining Alaska, Arizona, South Dakota, Georgia, Kansas, South Carolina, Indiana, Wisconsin, Kentucky, Tennessee, Metro Washington, and Montana.
Oregon reached its annual goal for the first time. ACEC/PAC Champion Jack Beemer of David Evans and Associates credited the leadership of the state organization for making "ACEC/PAC fundraising a priority."
"I knew we could do this if our state Board of Directors signed on and made ACEC/PAC fundraising a priority," said Beemer. "We developed a list, and each of us signed up for the calls we wanted to make. This made each of us accountable, and, because we were all stakeholders in this effort, we succeeded."

For the second year in a row—and third time in the last four years—Hawaii met its ACEC/PAC objective. "Despite tough economic times," said ACEC/PAC Champion David Bills of Bills Engineering in Honolulu, "our members in Hawaii understand that now, more than ever, we need a strong national organization looking out for our best interests—especially on Capitol Hill."

| ACEC Minuteman Fund Supports Metro Washington Amicus Brief

ACEC has awarded a Minuteman Fund grant to ACEC/Metro Washington for the filing of an amicus brief that supports a federal district court ruling that the National Flood Insurance Act (NFIA) bars state law claims against engineering firms providing services to the Federal Emergency Management Agency (FEMA) under the Act.
In September 2006, Columbia Venture sued Dewberry & Davis, an engineering firm based in Fairfax, Va., in federal district court in Columbia, S.C. over engineering services that Dewberry had provided to FEMA under the NFIA. Having no recourse under federal law for the suit, Columbia Venture asserted its claims under state law.
On February 14, 2008, the district court granted Dewberry's motion to dismiss the case, finding that NFIA preempts state law causes of action. Columbia Venture then filed its appeal with the United States Court of Appeals for the Fourth Circuit.
"We believe this suit is of vital importance to the engineering industry," said ACEC/Metro Washington President Courtney Brown. "We're very appreciative of ACEC and the Minuteman Fund for their help in defending this crucial principle of law."
The Minuteman Fund is ACEC's most powerful resource for helping Member Organizations pursue legislative and legal initiatives of national importance. All member firms are encouraged to contribute to the Fund.
