| Victory For Design Firms Achieved In Nevada Supreme Court; ACEC Role "Instrumental"

The Nevada Supreme Court has issued a landmark ruling that strongly protects a design firm's ability to limit its liability for a client's commercial losses on a project.
When a client and a service provider have contractually agreed to limits on the provider's liability and the client then experiences purely economic losses, the Economic Loss Doctrine would essentially bar the client from obtaining a higher monetary award than the contract permits. In the present Nevada Supreme Court case of Terracon v. Mandalay Resort Group, the Court held that the Economic Loss Doctrine specifically protects engineers and architects.
ACEC filed a joint amicus brief with ACEC/Nevada, the Design Professionals Coalition, AIA, NSPE, ASFE and ASCE to defend the Economic Loss Doctrine. The brief was co-authored by the Las Vegas law firms of Beckley Singleton and ACEC affiliate member law firm Morris Polich & Purdy. ACEC provided financial assistance for the brief through grants from the Minuteman Fund, DPC, and ACEC/Nevada. The ACEC Legal Counsel Forum also reviewed the brief and provided valuable comments.
"This is a tremendous victory for the engineering industry," said ACEC/Nevada President Cindy Potter of CH2M HILL. "We are grateful to ACEC for its instrumental role in helping to defend the Economic Loss Doctrine in Nevada. The decision establishes a great precedent that we hope other states will follow."

| ACEC's Neimeyer Participates In Obama's Online Town Hall At White House

ACEC Treasurer Terry Neimeyer, who was seated in the front row at President Obama's online town hall meeting held last week at the White House, is chairman and CEO of KCI Technologies, Inc. in Hunt Valley, Md. "I was enthused about the Administration's strong commitment to infrastructure funding," said Neimeyer.
"The president talked about making immediate investments in the short term that you know will pay off in the long term," he said. "That is the key argument in favor of investing in our nation's infrastructure."
Neimeyer was prepared to ask a question about infrastructure, but wasn't called upon. "I wanted to ask him how he reconciles his go-green policy of minimizing foreign oil use with an infrastructure policy that is funded by the gas tax," he said. ACEC supports the eventual replacement of the gas tax with a Vehicle Miles Traveled tax because it will provide a more consistent flow of revenues for infrastructure funding.
Neimeyer came away from the town hall meeting very impressed. "He speaks as well as Bill Clinton did, but there is a difference in that his intelligence is just so plainly obvious," he said.

The ACEC Annual Convention, April 26-29 in Washington, D.C. will place special emphasis on how to navigate through stormy economic waters.

U.S. Secretary of Transportation Ray LaHood will address ACEC members at the Convention's 100th Anniversary Luncheon on Monday, April 27. He follows noted CNN political analyst David Gergen, who will address Convention attendees during the Opening General Session earlier that day.
Convention attendees also will converge on Capitol Hill to advocate important industry initiatives—including funding for surface transportation, water infrastructure, aviation, and defeat of the 3 percent withholding mandate—as part of the engineering industry's largest legislative event.
Other Convention highlights include a Centennial Soiree Opening Reception and Dinner featuring the Capitol Steps comedy troupe on Sunday, April 26, and the 43rd Annual Engineering Excellence Awards Gala—the "Academy Awards" of the engineering industry—on Tuesday, April 28.
