| ACEC Testifies At IRS Hearing To Urge Repeal Of 3 Percent Withholding
 Katharine Mottley, ACEC's director of tax and regulatory affairs, testified before the IRS last week on behalf of the Government Withholding Relief Coalition. |
ACEC delivered testimony before the Internal Revenue Service last week on behalf of a large coalition of business organizations in opposition to the 3 percent withholding mandate.
The IRS is gathering industry input as it finalizes the regulations for the mandate, which is slated to take effect in 2012.
Katharine Mottley, ACEC's director of tax and regulatory affairs, testified as part of the Government Withholding Relief Coalition, which consists of more than 90 governmental organizations, trade associations, and businesses.
In addition to expressing ACEC's and the coalition's strong opposition to the mandate, Mottley's testimony focused on specific implementation problems, such as the rule's onerous impact on so-called "pass through" entities, including subchapter S corporations, partnerships and sole proprietorships. Coalition testimony also emphasized that the only viable solution to this and other problems with the mandate is outright repeal.
ACEC members will lobby Congress during the Annual Convention to build support for 3 percent withholding repeal bills in the House and Senate. For more information, contact Katharine Mottley at kmottley@acec.org.

| Minuteman Fund Supports QBS Victory In West Virginia, Awards Grants To FL, NH

In a major legislative victory for the engineering industry, ACEC/West Virginia has successfully defended the use of Qualifications-Based Selection (QBS) for the procurement of engineering services in the state.
The Member Organization defeated legislation introduced by the Governor to modify the state's QBS law, and also successfully countered a statewide public relations campaign intended to garner support for the legislation.
The ACEC Minuteman Fund helped to support the M.O.'s advocacy efforts.
"By simply providing fact-based information, we removed any underlying politics from this issue and successfully educated legislators about the benefits and merits of the QBS procurement process," said Darrell Buttrick, executive director, ACEC/West Virginia. "It is our hope that any future efforts undertaken by the state administration to modify the QBS procurement process will include participation from key stakeholders within our association."
Buttrick noted that throughout the advocacy process, ACEC/West Virginia clearly established its willingness to work with the administration to ensure that the state's project management processes are efficiently administered.
"The leadership of our Board clearly motivated our membership to engage in the legislative process, and our membership is to be highly commended for heeding the call to duty. We also greatly appreciate the support provided by the ACEC Minuteman Fund."
In other Minuteman Fund activity, grants were recently awarded to ACEC/Florida and ACEC/New Hampshire to help defray their respective legal costs for defending the use of limitation of liability clauses in engineers' contracts and to fight state legislation that could force design firms in civil lawsuits to pay a disproportionate share of damages.

| ACEC Members Poised For Lobbying Blitz During Convention

ACEC members will converge on Washington, D.C. next week for the industry's largest annual lobbying effort as part of the Council's 2009 Annual Convention.
ACEC's "Citizen Lobbyists" will visit Capitol Hill to advocate for several critical industry issues, including a new six-year surface transportation program to replace SAFETEA-LU; new legislation to boost funding for water infrastructure projects and expand the reach of QBS; repeal of the onerous 3 percent withholding mandate; and congressional support for contracting out.
Two senior House leaders—Rep. John R. Duncan (R-TN), the ranking member on the House Committee on Transportation and Infrastructure, and Rep. John Boozman (R-AR), ranking member of the House Water Resources and Environment Subcommittee—will brief Convention attendees on key infrastructure issues prior to the Capitol Hill visits.
In addition, Rep. Kendrick Meek (D-FL), who is the champion of the fight to repeal the 3 percent withholding, will provide an update of the repeal efforts.

Hanlon, director of the EPA Office of Wastewater Management, will provide a special inside update on the $6 billion in new funding available under the American Recovery and Reinvestment Act (ARRA) for local water and wastewater projects through State Revolving Funds.
