Strong ACEC Grassroots Effort Defeats
Anti-QBS Challenge In Texas

An effort to undermine the Texas state Qualifications-Based Selection (QBS) process has been soundly rejected by the state legislature following an intense lobbying effort by ACEC’s Texas State Organization and allied design industry groups.

The anti-QBS amendment, offered during debate over a larger bill governing the state’s Department of Transportation, would have required engineering firms in the state to compete for DOT contracts through cost-based bidding.

The Texas Council of Engineering Companies (TCEC) mobilized strong opposition to the amendment, which was rejected by a vote of 117-21.

"This was an important win for us, and a real testament to the grassroots strength of the engineering industry in the state," said TCEC President Steve Stagner. "Good public policy won the day, but I have no doubt that we'll face new threats like this one down the road, which means we have to stay vigilant."

"This is a good example of how proactive legislative and political engagement can protect the public and support our industry," added TCEC Chairman Bob Jones of Jones & Carter. "If we want good policies at the state and national levels, we have to be prepared to fight a long, continuous battle."


Limitation of Liability at Forefront of ACEC/Virginia and Metro Washington Action

The ACEC Minuteman Fund has awarded a grant to ACEC/Virginia and ACEC/Metro Washington to support their joint effort to enact legislation reinforcing the right of A/E firms to contractually limit their liability.

This legislative move comes in response to a recent case in Arlington County, Va., The Bromptons @ Cherrydale, LLC v. Meyer Consulting Engineers Corporation. Although the case settled before trial, the court expressed the view that limitation of liability (LOL) clauses in professional services contracts are unenforceable under Virginia state law.

The law firm of Williams Mullen has been retained to lead the effort to win LOL legislation.

"Limitation of liability clauses are one of the primary contractual defenses that engineering firms have and the legislation we are advocating will help to ensure that such clauses are recognized in this state," said ACEC/Virginia Executive Director Nancy Israel.

The Minuteman Fund is ACEC’s most powerful resource for helping Member Organizations pursue legislative and legal initiatives of national importance. All Member Firms are encouraged to contribute to the Fund.

Time Running Out To Take ACEC’s Professional Liability Insurance Survey

The 2009 ACEC Professional Liability Insurance Survey of Member Firms for Fiscal Year 2008 will run for only one more week, through Friday, June 5.

This annual survey collects critical information on Member Firms' professional liability insurance, their claims experience, and the impact of the threat of litigation. An email with a link to the survey has been sent to Member Firm key contacts. If your firm has not yet received this link, click here to access the survey.

Member Firms that respond to the survey will receive a free copy of the complete results upon request. The survey results will also be available for sale through the ACEC Bookstore.

"As is the case every year, this information is crucial to determining the professional liability insurance landscape which our members must work with. It also provides important data for our tort reform efforts in Congress," said Charlie Geer, senior vice president of Kimley-Horn and Associates and chairman of the ACEC Risk Management Committee. "I strongly encourage each Member Firm’s headquarters office to participate in this survey."

The results of the survey will be compiled and a summary published in the July/August 2009 issue of Engineering Inc.
