| AASHTO Audit Guide Panel, Vicente Fox Lead Full Slate at ACEC Fall Conference
 ACEC/PAC’s annual golf tournament, which will take place at La Quinta’s Mountain Course—home to the World Cup and the PGA National Cup Championship—features a $25,000 hole-in-one contest and is just one of the many Fall Conference highlights. |
Attendees at the upcoming Fall Conference, October 7-10, in Palm Springs, Calif., will profit from a wide-ranging four-day event featuring top-notch education programs, world-class speakers and exciting social activities.
The Conference will present the first release of the AASHTO Uniform Audit and Accounting Guide—a must-attend event for all firms that have state DOT clients. The session will include expert analysis of the new AASHTO Guide, featuring Jerry Jones, who chaired the AASHTO Audit Guide Taskforce, and Joseph Daily, director of the Office of Financial Management at the Federal Highway Administration.
Addressing the Opening General Session will be former Mexican President Vicente Fox, who has earned international acclaim as an expert on global economic and political issues. Later in the day, David Doody, flight operations lead engineer for NASA’s Cassini Mission, will share some of the amazing discoveries of Saturn and its moons.
ACEC/PAC will host three exciting events: a golf tournament at the exclusive Mountain Course, featuring a $25,000 hole-in-one contest; a sunset Martini Reception at the luxurious La Quinta Clubhouse; and the Sweepstakes Raffle drawing with $18,000 in cash rewards, including the $10,000 grand prize.

| House Members Praise ACEC, Honoring Council's 100-Year Anniversary

When the House of Representatives last week approved a resolution recognizing ACEC for its 100 years of service to the industry and the nation—by a 420-0 vote—several House Members paid tribute to the Council and the engineering industry.
“In the fight to rebuild and renew America, the American Council of Engineering Companies is at the forefront,” said Congressman Earl Blumenauer (D-OR), a leading advocate of infrastructure investment in Congress. “I hope our members not only celebrate this 100th anniversary, but maybe use this as an opportunity to take the time to look at the resources that ACEC gives to us to help us do our job better.”
Congressman Ralph Hall (R-TX), the senior Republican on the House Science Committee, praised the Council and its large chapter in Texas, saying that ACEC is “an effective and growing advocate for advancing the practice of consulting engineering and the promotion of private enterprise.”
Congresswoman Eddie Bernice Johnson (D-TX), who chairs the House Water Resources and Environment Subcommittee, said “Through its help, America has some of the best engineering structures in the world that allow us to drink fresh water, travel efficiently, and lead an all-around healthier and happier lifestyle.” The Texas lawmaker added that “we have all benefitted immensely from the Council’s efforts and dedication to improving the lives of every American citizen, and I extend my deepest thanks and appreciation for their hard work.”

| ACEC Young Professional of the Year Award Entry Deadline is October 12
Member Organizations and Member Firms seeking to recognize the achievements of a young engineer must submit their entry for the ACEC 2010 Young Engineer of the Year Award by October 12, 2009.
The Award acknowledges the accomplishments of engineers under the age of 30 who, while still at the beginning of their engineering careers, already have made significant contributions to the profession. Nominees will be evaluated by the Awards Subcommittee of the Committee of Fellows.
Award winners will be recognized at the 2010 ACEC Fall Conference and in Engineering Inc. magazine and will automatically compete for the 2010 New Faces of Engineering Awards, which are coordinated through National Engineers Week.

| ACEC Supports Contractor Indemnification on Liability Issues Panel
In a panel discussion on liability issues at the annual Society of American Military Engineers (SAME) Executive Forum in Springfield, Illinois, ACEC’s Senior Policy Director Mark Steiner emphasized the need to indemnify, provide immunity, or insure contractors on large infrastructure projects. An infrastructure malfunction, Steiner said, could result in catastrophic losses and expose the contractor to enterprise-ending liabilities.
Noting that contracts with federal agencies can mitigate, but not eliminate liability risk for federal work, the panelists discussed a number of ideas to establish legal protections for contractors engaged in high risk government and private infrastructure work:
- Establish a National Infrastructure Safety Board (NISB), to determine negligence for infrastructure malfunctions.
- Limit suits for critical or catastrophic losses to federal courts, including rejection of suits, where no negligence exists.
- Set liability limits or federal insurance for amounts over those limits.
ACEC is developing education programs on the limited protections when performing work for the federal government and insurance options.
Member Firms that work for federal agencies are also encouraged to join the Federal Agency and Procurement Advocacy Committee, which promotes liability reforms and other issues of interest to ACEC members engaged in contracting with the federal government.

Cameron, senior litigation partner, Donovan Hatem, New York, and a litigator of complex construction and commercial matters in federal and state courts; and the Honorable Arthur Bergman, New Jersey Superior Court Judge, who has presided over numerous construction cases and previously spent 13 years representing design professionals, owners and contractors.
