FHWA Backs ACEC's Call to Disallow Unilateral Fee Reductions by State DOTs

Responding to ACEC concerns, the Federal Highway Administration (FHWA) has ruled that state agencies may not unilaterally reduce contracted fees for consultant services on federally funded transportation projects.

FHWA’s guidance came in response to the Wisconsin DOT, which was moving forward with a plan to force across-the-board fee reductions on existing contracts to meet state budget constraints.

In a letter that outlines the procedures that state agencies must follow when attempting to reduce contracted fees, FHWA Division Administrator Allen Radliff wrote, “Unilateral modifications in the pricing of architectural and engineering contracts without engaging in good faith negotiations with the contracting firms is inconsistent with Brooks Act procurement requirements.”

ACEC had strongly objected to the Wisconsin DOT plan. In a letter to Wisconsin state officials, ACEC President Dave Raymond highlighted numerous concerns, including potential violations of federal procurement laws. FHWA acknowledged ACEC’s role in collaborating with the state to reduce expenditures and improve the efficiency of program delivery. Radliff stated that Wisconsin could lose federal highway funding “absent demonstration that a bona-fide opportunity was provided to the firm to re-negotiate a fair and reasonable price” or a commensurate change in the scope of services or other terms of the contract.

While FHWA’s letter was directed to Wisconsin DOT, FHWA officials have indicated the requirements are broadly applicable to any state considering a similar course of action.

Minuteman Fund Helps ACEC/Maine Defend Infrastructure Funding

The ACEC Minuteman Fund has provided a grant to ACEC/Maine to support its efforts to defeat two anti-infrastructure ballot initiatives.

One of the initiatives would put a spending cap on the state’s Highway Fund and other accounts; the other would cut the motor vehicle excise tax in half, which could force municipalities to cut infrastructure investment.

“These two ballot initiatives, if passed, would have a significant negative impact on spending for infrastructure projects in Maine,” said Scott Graham, president of ACEC/Maine. “We are glad that the ACEC Minuteman Fund is available to help us fight these battles.”

The Minuteman Fund is ACEC’s powerful resource for helping Member Organizations pursue legislative and legal initiatives of national importance. More than 300 Firms Participate in First AASHTO Guide Online Seminar

Five-Webinar Series Analyzes Key Aspects of New AASHTO Audit and Accounting Guide

Recognizing the substantial impact that the new AASHTO Uniform Audit and Accounting Guide will have on their businesses, more than 300 transportation-oriented engineering firms participated in ACEC’s online seminar AASHTO’s New Uniform Audit and Accounting Guide: New State DOT Compensation and Audit Rules That Will Affect Your Bottom Line on Tuesday.

This comprehensive overview of the new Guide was one of the most highly attended online sessions ACEC has ever offered, and the first in a series on the AASHTO Guide to be held over the coming weeks.

“To have seminars regarding the AASHTO Audit Guide so quickly after its release demonstrates the value of ACEC and ACEC membership,” said Mike Webber, CFO of AE Finance in Downers Grove, Ill.

Next up in the series will be the AASHTO Uniform Audit and Accounting Guide: New Rules on Allowable and Reasonable Compensation session on November 5. ACEC Hosts Conference on Project Opportunities in Developing Countries


Ellen Moran, senior director for infrastructure at the Millennium Challenge Corporation, briefed ACEC’s International Committee members on business opportunities in developing countries.

International business experts briefed ACEC members this week on opportunities in developing countries.

Ellen Moran, senior director for infrastructure at the Millennium Challenge Corporation (MCC), gave an overview of the agency, its selection process for grants to low-income nations, and the implementation of country Millennium Challenge Accounts (MCAs).

MCC administers $7 billion in grants to 19 nations, with 63 percent of the grants dedicated to infrastructure projects. MCC Procurement Director Gerald Nash described how firms can take advantage of these opportunities in the transportation, water and energy sectors.

Paul Curry, alternate U.S. executive director of the Asian Development Bank (ADB), discussed the bank’s strategy to cast itself as an “infrastructure bank.” He emphasized the importance of “person-to-person contacts” in establishing business relationships in Asia and said that ADB stood ready to work with ACEC members as a “gateway to Asian markets.”

ACEC’s International Committee, which sponsored the conference, is chaired by Manish D. Kothari, president of Sheladia Associates in Camp Hill, Pa., and vice-chaired by Sergio Pecori, president and CEO of Hanson Professional Services in Springfield, Ill.

Land Development Projects to be Highlighted in Engineering Inc.

ACEC will highlight four Member Firms and their land development or land reclamation projects in the January/February 2010 issue of Engineering Inc.

If your firm has provided surveying, geotechnical or other site development services for a developer, and you think the project would be of interest to Engineering Inc. readers, ACEC would like to hear from you. The project can be in an on-going phase or recently completed.

To submit a project for consideration, please e-mail the following information to Engineering Inc. Staff Editor, Andrea Keeney, at akeeney@acec.org by Monday, November 16:

  • Project name and location;
  • Brief project overview, including any unique aspects; and
  • Name, title and phone number of the Member Firm executive who will be interviewed for the profile.

If your project is selected, a reporter will interview the Member Firm executive to discuss original project goals, what challenges were faced and how these issues were overcome. The firm also will need to submit a formal, color headshot of the executive interviewed (hi-resolution — 300 dpi), as well as project photo(s) for inclusion in the magazine.
