| Major ACEC Win on Project Labor Agreements Protects Engineering Firms
In a victory for the engineering industry, the Council successfully secured the exclusion of engineering services from the final rule implementing President Obama’s Executive Order mandating that Project Labor Agreements (PLAs) be used on major construction projects involving federal funds.
“This is a significant step forward that will protect the independence of engineers, surveyors, and engineering professionals on construction sites,” said Bob Fogle of HNTB
Corp.
ACEC raised concerns that the proposed rule implementing the President’s PLA policy did not distinguish between those performing direct construction work onsite and those performing other services. ACEC argued that applying such a requirement could create conflicts of interest for engineering firms that perform critical oversight and quality assurance roles at construction sites.
The final PLA rule, which was published this week in the Federal Register, specifically acknowledges the concerns raised by the Council, stating, “This change makes clear that employers who do not perform construction work need not sign the project labor agreement.”
“This victory for ACEC is on par with a number of previous Council accomplishments, such as FSLA reforms, 9 percent tax deduction, and shutting off FAR ‘opt-out’,” said ACEC President Dave Raymond.

| ACEC/PAC and Florida record first win in 2010 Elections

ACEC/Florida made good use of the national PAC to back the winning candidate in a special election this week to fill the seat of a retiring House member.
Florida State Senator Ted Deutch (D-FL) won the nation’s first congressional election of 2010, providing ACEC/FL and ACEC/PAC with a big victory to kick off this year’s campaign season. Deutch won with a sizeable lead in a three-way race.
“This is great example of solid teamwork between the ACEC national office and our state chapter,” said National Director Charlie Geer of Kimley-Horn and Associates, Inc. “Thanks to our involvement and ACEC/PAC’s early support, we were one of the first PACs in the nation to contribute to the Deutch campaign.”
Deutch replaces Rep. Robert Wexler (D-FL) in the 19th District, which represents Palm Beach and Broward counties. As a member of the Florida Senate Judiciary Committee, Deutch has been very active in working with ACEC/FL on legislation to protect design professionals from unreasonable liability, an issue that has drawn national attention this year.
ACEC/FL Executive Director Frank Rudd echoed Geer’s comments: “We have a new Member of Congress who really understands engineers and infrastructure issues.” |
