Legislation Targets Unfair California Court Indemnification Rulings

ACEC/California has introduced a bill in the state legislature to overturn two recent state court rulings that impose grossly unfair indemnification obligations on A/E firms.

ACEC has provided a Minuteman grant to support ACEC/California’s efforts to neutralize the negative consequences of the court decisions.

In Crawford v. Weather Shield Mfg. Inc. and UDC-Universal Development, L.P. v. CH2M HILL, the courts have ruled that engineers may have a duty to pay the legal costs of a client when that client is sued, even if there is no allegation that the engineer was negligent.

In the UDC case, the court held this obligation existed even though the trial court found that CH2M HILL was neither negligent nor in breach of contract. The California Supreme Court recently declined to review the UDC case.

ACEC/California’s bill, S.B. 972, is moving through the state Assembly, recently clearing the California Senate Judiciary Committee on a 4-0 vote.

ACEC/California National Director Rob Salaber and ACEC Risk Management Committee member Tom Bongi testified before the committee in support of the legislation.

Rep. Olver Says "Doubling Infrastructure Funding" Would be a Good Start

Rep. John Olver (D-MA) said in a meeting last week at ACEC headquarters that federal transportation infrastructure funding “needs to be doubled” just to take care of current maintenance and improvement needs.

Olver encouraged ACEC and its members to continue lobbying lawmakers and the Administration to increase funding for infrastructure programs.

Olver, who is chairman of the House Appropriations Subcommittee on Transportation, Housing and Urban Development, met with ACEC President Dave Raymond and representatives from ARCADIS, CH2M HILL, Jacobs Engineering, and Parsons Brinckerhoff.

“Congressman Olver has been at the forefront of shaping our nation’s transportation policy, and has been a strong advocate for fully funding our nation’s transportation needs,” Raymond said. “It was terrific to have a real dialogue with him on these key issues.”


Minuteman Fund Grants Awarded for Liability Limits; Contracting Out Defenses

The ACEC Minuteman Fund has awarded grants to ACEC/Florida to support liability limitation legislation, and to ACEC/New York to fight union anti-contracting out efforts.

In the case of Witt v. La Gorce Country Club, a Florida trial court found that limitation of liability clauses are not applicable to individual engineers. ACEC/Florida is pursuing both an appeal of this ruling and legislation to counter the adverse consequences of the decision.

In New York, the largest public employee union has launched an anti-outsourcing campaign that includes television ads and print media, and has introduced legislation that would either eliminate or severely limit outsourcing. ACEC/New York will use the Minuteman Fund grant to counter the union’s campaign through advertising and public outreach efforts.

“The Minuteman Fund helps to protect and promote the business of engineering across the country, and for that we are glad to offer our support,” said Doris Willmer, president of Willmer Engineering in Atlanta and national director of ACEC/Georgia.

“We’ve seen the Minuteman Fund do a tremendous amount of good in advancing QBS, defending contractual protections for engineering firms, and a whole host of other issues critical to our industry,” said Rick Toole, president of W.R. Toole Engineers in Augusta, president of ACEC/Georgia and a trustee of the ACEC Life/Health Trust.

ACEC Backs Private Activity Bond Bill to Boost Water Infrastructure

The Sustainable Water Infrastructure Investment Act of 2010, which has just been introduced in the Senate, would free up billions of private capital dollars for investment in the nation’s water infrastructure by removing state volume caps on private activity bonds (PABs) for water and wastewater projects.

ACEC supports the bipartisan bill, which was introduced by Sen. Robert Menendez (D-NJ) and co-sponsored by Sen. Kit Bond (R-MO), Sen. Mike Crapo (R-ID), and Sen. John Kerry (D-MA).

A similar bill was passed by the House as part of the Small Business and Infrastructure Tax Act (H.R. 4849) last month.

PABs are tax-exempt bonds issued by or on behalf of local or state governments for the purpose of financing private projects. PAB issuance is one of the fastest forms of federal assistance when applied to water and wastewater projects, with only 90-120 days needed to complete the process from approval to sale to starting the project.

The General Accounting Office estimates that the bill would create up to 57,000 jobs.


ACEC Life/Health Trust Provider Awarded Full NCQA Accreditation

The National Committee for Quality Assurance (NCQA) has awarded full accreditation to UnitedHealthcare, the underwriter for the ACEC Life/Health Insurance Trust, for providing access to quality care and service for its customers.

NCQA Health Plan Accreditation is a nationally recognized independent evaluation that employers, regulators and consumers use to assess health plans. The accreditation process evaluates all parts of a health plan’s delivery system, from physicians and hospitals to other health care providers and administrative services.

In addition, UnitedHealthcare was one of only two national insurers to receive additional certification for physician and hospital quality programs. “Accreditation reflects a health plan’s ability to work with physicians to improve the quality of clinical care to enhance customer service,” said Margaret E. O’Kane, president of NCQA. “We applaud UnitedHealthcare for its efforts in collaborating with the medical community and its health plan participants to deliver great service and great care.”

California Court: Engineering Firm Not Negligent, Pay Anyway

May 20-21, San Francisco

As a recent California appellate court decision demonstrates, A/E/C contracts are continuously being challenged in the courts.

In the California case—UDC v. CH2M HILL—the court ruled that it was a design consultant’s duty to pay the legal costs of its developer client against a negligence action brought by a homeowners’ association—even though there was no underlying direct claim of negligence against that consultant. In the decision, though the consultant was found not negligent, the Court still imposed an obligation upon the firm to pay under the indemnity clause contained within the parties’ contract.

Anti-ID Theft Policy Deadline is June 1, Credit-Granting Firms Must Comply

May 19, 1:30-3 p.m.

In 2008, the Federal Trade Commission issued new regulations providing that businesses that extend credit must establish a written ID theft prevention policy (the ‘Red Flags Rule’). Deadline for compliance is June 1, 2010.

A/E firms could be subject to this rule, and even if a firm is arguably not covered, it is good business practice to have an anti-ID theft policy in place. Thomas A. Cohn, Venable LLP, presents an informative online seminar, FTC’s ID Theft “Red Flags Rule:” Will Your Firm Comply by June 1? on May 19, 1:30-3 p.m.

Cohn will answer questions that every A/E firm should be asking about the Red Flags Rule:
