Member Action Needed to Fight S Corporation Tax Increase
The Senate is expected to try again this week to pass a tax “extenders” bill that includes a problematic provision that would increase payroll taxes on certain S corporations.
ACEC pared back the original language, which would have applied the tax increase to all S corporations, and is now focused on minimizing the impact of the legislation on small firms.
The Council encourages members to contact their Senators on the matter.

| Congress to Consider ACEC-Backed Good Samaritan Bill
House leaders are poised to reintroduce legislation this week that will provide Good Samaritan protection for engineers who volunteer their services after a major disaster.
The ACEC-backed "Good Samaritan Protection for Construction, Architectural, and Engineering Volunteers Act" would give architectural, engineering and construction companies qualified immunity from liability when providing services or equipment on a volunteer basis in response to a declared emergency or disaster.
ACEC is also working to advance H.R. 847, legislation that would limit the liability of engineering firms that worked at Ground Zero after 9/11, as well as broader efforts to provide liability relief to emergency responders.

| ACEC/California Leads Efforts to Overturn Ruinous Court Decisions
ACEC urges Member Firms with business interests in Calfornia to support ACEC/California’s efforts to legislatively counteract two recent flawed state court decisions—Crawford v. Weather Shield Manufacturing Inc. and UDC v. CH2M HILL.
Under the decisions, design professionals can be required to pay their client’s attorney fees in the event of a lawsuit, even if the engineering firm was neither negligent nor in breach of contract.
ACEC/California has sponsored a bill in the California legislature to reverse the impact of the decisions on engineering firms. The legislation has passed the state Senate and is about to go before the state Assembly.
The Council, which has supported ACEC/California’s efforts through The Minuteman Fund, encourages the California offices of ACEC Member Firms to contact state Assembly members and lobby for passage of the legislation. Click here for a sample letter.

| Arnold Windman, ACEC Chairman and Industry Leader, Dead at 83

Arnold Windman, a pillar of the engineering industry and ACEC chairman in 1985-86, died last weekend in Hilton Head, SC.
While ACEC Chairman, Windman was instrumental in the formation of the American Tort Reform Association, the leading voice for tort and liability reform nationwide.
Windman spent his entire 40-year career with Syska & Hennessy in New York City, and participated in iconic projects such as the United Nations Building, LAX Terminal, Lincoln Center, and The National Gallery of Art. He rose to vice-chairman of the firm and was instrumental in its rapid growth both domestically and internationally.
“Arnold Windman was that unique man who was dedicated to his family, his firm and his industry,” said John Hennessy III, who worked with Windman at Syska & Hennessy and was himself ACEC Chairman in 2008-2009. “In particular, Arnold was dedicated to making our industry better, spending countless hours involved in ACEC activities both on the local and national level.”

In the course of five separate five-day sessions over an 18-month timeframe, ACEC's Senior Executives Institute (SEI) participants acquire new tools and high-level skills and insights to prosper in our changedand challengingA/E/C business environment.
Since its inception, SEI has attracted public and private sector engineers and architects from firms of all sizes, locations, and practice specialties, who are drawn to a highly interactive, energetic, exploratory and challenging learning opportunity. Class 16 begins in September 2010.
Course size is limited, and registrations for Class 16 are being accepted. Executives with at least five years' experience managing professional design programs or businesses are invited to register for this highly regarded leadership building opportunity.
