Minuteman Fund Helps ACEC/Indiana Achieve Critical State Court Victory


ACEC/Indiana President Roland Salman hailed a “major victory for engineering firms.”
In a landmark court case limiting the liability of engineering firms, the Indiana Supreme Court has barred “economic loss” claims against design firms based on alleged negligence.

The case involved a suit by the Indianapolis Public Library against an engineering firm and others claiming economic losses stemming from purported design and construction flaws. The Supreme Court ruled that such a negligence suit could not be brought for purely economic damages.

ACEC/Indiana had filed an amicus brief in the case with support from the Minuteman Fund.

“This decision is a major victory for engineering firms doing business in Indiana,” said Roland Salman, president of ACEC/Indiana. “Our amicus brief was cited by the Supreme Court in its decision, and we want to thank the Minuteman Fund for helping to make the brief possible.”



ACEC's Advocacy Agenda on Tax Issues Aims to Benefit Entire Industry

ACEC is pursuing a tax policy agenda that will benefit a broad range of engineering practices.

As Congress faces increased pressure to reduce the deficit, tax increases on business are being considered to offset spending.

In addition to fighting back a proposed tax increase on Subchapter S corporations, ACEC is working on a variety of other measures, including extension of the tax deduction for energy-efficient commercial buildings, and repeal of the recent increase in the number of Form 1099s that businesses must submit to the IRS.

ACEC/Colorado Fights Ballot Measures

A Minuteman Fund grant has been awarded to ACEC/Colorado to help combat three November ballot initiatives that would severely limit Colorado’s ability to fund infrastructure projects.

ACEC/Colorado has organized and led an unprecedented state-wide drive to raise funds for this campaign.

“We are very grateful for the assistance from the Minuteman Fund,” said Marilen Reimer, executive director of ACEC/Colorado. “Combined with the contributions from Member Firms, this grant will help us to mount a major effort to defeat these ill-advised ballot measures.”

An employee stock ownership plan (ESOP) can be a means of business succession and transition, with principals selling some or all of their stock ownership in the firm to the ESOP on a tax-favored basis.

Erin Turley, Morgan Lewis & Brockius LLP and Scott Levine, Stout Risius Ross, present a valuable online summary exploration of ESOPs as an alternative to sale of the firm to a third party, or as a tool for internal transition from one level of principals to the next, with dual benefits of accomplishing broader ownership and investment and eliminating the need for the next principals to access new capital.

SEI Challenges A/E Leaders; New Class Starts in September

In the course of five separate five-day sessions over an 18-month timeframe, ACEC's Senior Executives Institute (SEI) participants acquire new tools and high-level skills and insights to prosper in our changed—and challenging—A/E/C business environment.

Since its inception, SEI has attracted public and private sector engineers and architects from firms of all sizes, locations, and practice specialties, who are drawn to a highly interactive, energetic, exploratory and challenging learning opportunity. Class 16 begins in September 2010.

Course size is limited, and registrations for Class 16 are being accepted. Executives with at least five years' experience managing professional design programs or businesses are invited to register for this highly regarded leadership building opportunity.
