U.S. Procurement Policy Chief Briefs ACEC on Acquisition Reforms

Mark Steiner, ACEC senior policy director, (left) and James Blake of Greenman-Pederson, Inc. in Annapolis Junction, Md., (center) discuss changes in federal acquisitions policies with Dan Gordon of the Office of Federal Procurement Policy (right).

Dan Gordon, administrator of the Office of Federal Procurement Policy, outlined major changes in federal acquisition during a meeting this week with ACEC’s Federal Agencies and Procurement Advocacy Committee.

Gordon discussed the government’s three priorities for federal procurement: strengthen the acquisition workforce, make the acquisitions more efficient and less risky, and rebalance the relationship with contractors. He acknowledged the unique nature of engineering and how federal procurement rules should continue to emphasize the most qualified service providers.

The committee also heard from Corps of Engineers and Naval Facilities Command officials, and from Lisa Muniz, deputy director of the State Department’s Bureau of Overseas Buildings Operations (OBO), who emphasized the need for industry involvement in the agency’s programs. She challenged ACEC to identify what OBO can do “to promote innovation and cutting-edge technology as part of the design process.”

William Holley, GSA’s chief engineer, told committee members that recent sustainability focused design procurements had failed to attract any engineer-led teams, and asked for the industry’s help in enhancing the designer’s role in the GSA’s design-build process.

EPA Wastewater Survey Calls for $298 Billion in "Needed" Upgrades

The nation’s wastewater treatment infrastructure needs $298 billion in upgrades, according to the EPA’s 2010 Clean Watersheds Needs Survey Report to Congress.

Highlighted needs include $192.6 billion for publicly owned wastewater pipes and treatment facilities, $63.6 billion for combined sewer overflows, $42.3 billion for stormwater management, $24 billion for decentralized onsite wastewater systems and $23 billion for nonpoint source pollution prevention.

Wastewater infrastructure needs have increased 17 percent since the last EPA survey in 2004 due to aging infrastructure, population growth, more stringent water quality requirements and improved reporting. Eight states account for 58 percent of the needs: New Jersey, California, New York, Illinois, Ohio, Pennsylvania and Texas.

The 2010 Report to Congress is available on the EPA webpage. For more information, contact Diane Shea, director of environment and energy programs, at dshea@acec.org.

Explore Bottom-Line Benefits of an Employee Stock Ownership Plan

July 27, 1:30-3 p.m.

An employee stock ownership plan (ESOP) can be a means of business succession and transition, with principals selling some or all of their stock ownership in the firm to the ESOP on a tax-favored basis.

Erin Turley, Morgan Lewis & Brockius LLP and Scott Levine, Stout Risius Ross, present a valuable online summary exploration of ESOPs as an alternative to sale of the firm to a third party, or as a tool for internal transition from one level of principals to the next. ESOPs offer dual benefits of accomplishing broader ownership and investment and eliminating the need for the next principals to access new capital.

Participants will also learn how an ESOP can serve as a tool of corporate finance to achieve more favorable borrowing terms and more tax-efficient loan repayment.
