Action Needed to Urge Calif. Governor to Sign "Duty to Defend" Bill

Legislation protecting California design professional firms from grossly unfair "duty to defend" obligations has reached Governor Schwarzenegger’s desk and awaits his signature.

ACEC is calling on all Member Firms with offices in California to write the governor today and back his signing of SB 972, which was crafted by ACEC/California to counteract the dangerous consequences of two recent court rulings that impose on engineers a duty to defend when a client is sued by a third party, even if the third party does not allege that the engineer was negligent. ACEC Expresses Concerns over Small Business Lending Package

The House is expected to clear legislation this week designed to spur $30 billion in lending to small businesses, as well as provide additional tax incentives.

While the tax and finance components of the legislation have received broad support, ACEC has concerns that numerous procurement policy changes in the Senate version of the bill were included without proper oversight or industry input. Click here to see ACEC’s letter to House leaders.

In addition to creating a $30 billion loan fund to assist community banks in providing loans to small firms, the measure includes a one-year extension of bonus depreciation language, enabling businesses to write off half of the expense of new equipment purchases that enter service in 2010.

ACEC Calls for Senate to Move Forward on Renewable Energy Bill

ACEC has urged Senate leaders to act before the end of the year on a bipartisan renewable energy bill.

“The bill, which would stimulate development of the nation’s renewable energy resources, is an important piece of a comprehensive energy strategy,” said ACEC President Dave Raymond in a letter to Senate Majority Leader Harry Reid (D-NV) and Minority Leader Mitch McConnell (R-KY).
