Jones\, CPA\, CPCM | Stambaugh Ness \nAccounting Systems for DBE Firms\nApril 30\, 2025 from 1:30-2:30 PM Eastern \nA compliant accounting system is crucial for financial stability and contracting success. It is the expectation of DOTs that firms follow consistent practices when bidding\, booking\, and billing costs. This online class dives into the 15 requirements of the SF 1408 and provides strategies to fortify your existing system or identify a new software to meet DOT standards. Learn how to segregate costs\, identify unallowable expenses\, and optimize your software for success. \nLearning Objectives: \n\n\n\nDiscover the components of an adequate accounting system\nUnderstand the importance of segregating direct and indirect costs\nGain clarity on job costing\n\n\n\nPresenter: Robert E. SUMMARY:DoD Cybersecurity Maturity Model Certification Briefing
DESCRIPTION:Friday\, March 7\, 2025 from 11:00 AM – 12:00 PM Eastern \nAs a follow up from the ACEC Federal Agencies and Procurement Advocacy (FAPA) Committee’s Winter Meeting\, officials from the Department of Defense (DoD) including the U.S. Army Corps of Engineers (USACE) will brief current policies and future requirements of the DoD Cybersecurity Maturity Model Certification (CMMC) program. \nThe defense industrial base (DIB) faces increasingly frequent\, and complex cyberattacks. To strengthen DIB cybersecurity and better safeguard DoD information\, the DoD developed the Cybersecurity Maturity Model Certification (CMMC) Program to assess existing DoD cybersecurity requirements. The CMMC model is designed to protect Federal Contract Information (FCI) and Controlled Unclassified Information (CUI) shared with defense contractors and subcontractors during contract performance. The CMMC Program implementation date is 60 days after the publication of the final Title 48 CFR CMMC acquisition rule. CMMC assessment requirements will be implemented using a four-phase plan over three years. The phases add CMMC Level requirements incrementally\, starting with self-assessments in Phase 1 and ending with full implementation of program requirements in Phase 4. This phased approach is intended to allow time to train CMMC Third Party Assessment Organizations (C3PAOs) and for companies to understand and implement CMMC assessment requirements. \nThe costs and requirements that this new contract language will place on small firms are significant\, and it’s imperative that firms do not wait to assess their cybersecurity. \nA pending proposed FAR rule on Controlled Unclassified Information (CUI)\, which certainly relates to CMMC\, is available for ACEC comments. The deadline for member company feedback is Wednesday\, March 12. \nDo not miss this opportunity to hear directly from DoD about their upcoming cybersecurity requirements.

DESCRIPTION:Tuesday\, February 25\, 2025 from 1:30-2:30 PM Eastern \nRecently issued executive orders restricting diversity\, equity\, and inclusion (DEI) initiatives at federal agencies and among federal contractors will have significant impacts on engineering firms. Whether you are a business leader\, legal\, or human resources professional\, this program will have something for you. \nCollectively\, the executive orders create compliance and risk management challenges for businesses. Executive Order 13950 from September 2020 titled “Combating Race and Sex Stereotyping” is back. Under E.O. 14173 titled “Ending Illegal Discrimination And Restoring Merit-Based Opportunity\,” the Office of Federal Contract Compliance Programs (OFCCP) within the U.S. Department of Labor must cease promoting diversity and allowing or encouraging federal contractors and subcontractors to engage in workforce balancing based on race\, color\, sex\, sexual preference\, religion\, or national origin. Additionally\, federal contractors must certify that they do not have any DEI programs that violate any applicable federal anti-discrimination laws. This certification will be subject to the False Claims Act penalties. \nJoin Cate McCaffrey with Gibson Dunn to review the executive orders and their implications for firms that work for federal clients\, as well as risk management steps firms can take. \nLearning Objectives: \n\nUnderstand what federal requirements have changed and what remains the same\nConsider the strategic and practical workforce implications for your company culture\nIdentify the business processes and business systems that may need to be changed along with the necessary resources to address them\n\nPresenter: Cate McCaffrey\, Associate Attorney with Gibson Dunn \nFree for ACEC Members!

SUMMARY:Embracing Progressive Design-Build in Modern Engineering
DESCRIPTION:Wednesday\, February 19\, 2025 from 1:30-2:30 PM Eastern \nExplore the transformative potential of progressive design-build in today’s dynamic project delivery landscape. This session will delve into the practical considerations of early collaboration between owners and the design-builder team\, the integration of innovative contract practices\, and the strategic management of project risks and opportunities. This presentation will spend considerable time distinguishing progressive from traditional and\, most importantly\, why these difference require the project to be treated differently from a traditional design-build. Specific topics include bridging documents\, compensation structures\, when the “at-risk” shift occurs\, and why the “at-risk” shift changes\, fundamentally\, the risks assumed by the design team. Attendees will gain insights into the progressive design-build process\, enhanced by real-world examples and actionable strategies for applying these principles to achieve superior project outcomes for stakeholders. \nLearning Objectives: \n\nDefine and distinguish progressive design-build from traditional design-build approaches.\nRisk and cost management in a progressive design-build environment; how progressive design-build can mitigate risks and manage costs effectively\, showcasing tools and techniques for transparent cost estimation and control.\nUnderstanding strategies for enhancing owner-design-builder collaboration\, including stakeholder engagement from the project’s inception.\n\nPresenter: Zachory (Zach) Jones\, General Counsel\, EJCDC
