SUMMARY:Overruling Chevron: The Effects of the Supreme Court’s Loper Bright Decision
DESCRIPTION:Tuesday\, September 10\, 2024\, 1:30 – 2:30 PM Eastern \nIn Loper Bright Enterprises v. Raimondo\, the United States Supreme Court reversed the 40-year-old Chevron doctrine\, which required federal courts to defer to administrative agencies’ “reasonable” interpretations of unclear statutes. The Loper Bright decision is expected to shift the balance of power away from federal regulators and toward courts and regulated parties in disputes over the meaning of federal statutes. \nJoin Lucas Townsend as he offers further details on the Loper Bright decision and its limits. You’ll receive practical insights into how that decision may affect future agency rulemakings\, enforcement\, and litigation.  You’ll also review several other Supreme Court decisions this Term that\, together with Loper Bright\, will shape the power of the federal administrative state. \n  \nPresenter: Lucas Townsend\, Gibson\, Dunn & Crutcher LLP

SUMMARY:New Federal Ban on Noncompete Agreements
DESCRIPTION:Tuesday\, June 11\, 2024\, 1:30 – 2:30 PM Eastern \nThe Federal Trade Commission has issued a final rule that bans most noncompete agreements\, with the exceptions of existing noncompetes for certain senior executivesand owners of a firm that is being acquired. If and when the rule becomes effective\, employers must notify all other employees that their noncompetes will not be enforced. The rule is scheduled to take effect in August but has already been challenged in court. \nNoncompete agreements are often included in ownership or shareholder agreements to prevent someone from taking employees\, proprietary information\, and clients with them if they leave the firm. They are also routinely used in acquisitions of other firms. \nThis rule could significantly impact business decisions related to M&A as well as firm owners and employees currently working under such agreements. ACEC is offering a special webinar to help you understand what the new rule means to your firm and steps you can take to protect proprietary information. \nAfter attending this session\, participants will: \n\nUnderstand what is in the FTC rule\nLearn about other restrictive covenants\, such as non-solicit and non-disclosure agreements\, that the FTC might consider the equivalent of a non-compete\nUnderstand the legal challenges to the rule\nDiscuss approaches to protecting proprietary information and clients if the ban on noncompete agreements is upheld in court\n\nPresenters: Andrew Kilberg and Julian Kleinbrodt\, Gibson Dunn \n \n*The recording will be added to the class materials the following day.

Join representatives from the three Trusts for a complimentary introduction to the programs and learn how your firm can benefit from these rich benefits. \nThe ACEC Business Insurance Trust has been providing professional insurance solutions to member firms for over 40 years\, including exclusive benefits not commonly available with a local broker: deductible assistance\, access to legal experts\, claims advocacy\, risk management\, Coalition dues assistance\, and Convention reimbursement. The ACEC Life/Health Trust takes a long-term approach to employee benefits by striving for consistency and predictability. For more than 50 years\, they have served firms of all sizes and offer small members quality health care products and services generally only available to large firms. Firms and their employees participating in the ACEC Retirement Trust benefit from the collective buying power of the $2.5 Billion Trust\, and enjoy greater fiduciary protections; cost effective administration\, recordkeeping\, and reporting; and low-cost institutional-grade investments typically unavailable to individual firms. Plus\, every participant has access to a personal financial advisor and easy access to their online account\, education\, and investment resources. \nLearn about the Trusts here. \nNot available for this session\, join us June 5 or October 2 instead!
