Delegated design is when the construction contract requires the contractor\, subcontractor\, or supplier to engage the services of a licensed\, registered design professional to prepare the final design of a specific element of the completed project\, based on performance and design criteria in the construction contract. This is\, in effect\, a “mini design-build project within a project”. Because two different design professionals have their fingers in a delegated design\, many myths and misconceptions exist concerning delegated design and its attendant liability. The FRA also has implications for the Council on Environmental Quality (CEQ) pending plans to revise its federal government-wide regulations implementing NEPA\, including expected walk-backs of revisions to those regulations enacted in 2020.
