ACEC Supports Proposed Changes to U.S. DOT Rules for Disadvantaged Business Enterprises

The Council filed comments in support of key updates to the U.S. Department of Transportation regulations governing Disadvantaged Business Enterprise program qualifications, including an overdue inflationary increase in the personal net worth cap on DBE firm owners from $1.32 million to $1.6 million and excluding retirement assets from the PNW calculation. ACEC also strongly supported a change to facilitate interstate certification of DBEs, once a firm is certified in its home state, to ease compliance and relieve administrative burdens.

“The proposed updates will preserve the viability of the DBE program and continue to provide qualifying firms with important business opportunities,” wrote ACEC President Linda Bauer Darr.

A final rule is expected to go into effect sometime in 2023.
