Restoring Common Sense to Federal Procurement
- Purpose: Revamp the Federal Acquisition Regulation (FAR), which the White House criticizes as overly complex and burdensome.
- Goal: Create a more agile, effective, and efficient procurement system by:
- Removing undue regulatory barriers.
- Eliminating FAR provisions not required by law or essential to sound procurement.
- Timeline:
- Within 15 days: Agencies must appoint a senior acquisition/procurement official to lead FAR realignment.
- Within 20 days: The Office of Management and Budget (OMB) Director will issue implementation guidance via memo.
- Within 180 days: The FAR Council, agency officials, and the Office of Federal Procurement Policy (OFPP) must coordinate to align the FAR with the EO.
- OFPP Administrator will oversee the removal ("sunsetting") of outdated FAR provisions.
Executive Order on Ensuring Commercial, Cost-Effective Solutions in Federal Contracts
- Purpose: Promote the use of commercially available products and services in federal acquisitions.
- Goal: Reduce wasteful and unnecessary spending on custom or government-unique systems.
- Timeline:
- Within 60 days: Contracting officers must review:
- All open solicitations and notices (including sole-source awards).
- Custom-developed or non-commercial procurements.
- Solicitations lacking evidence of suitable commercial alternatives.
- Reviews must include market research and price analysis.
- Within 30 days of purchase application: Senior procurement executives must:
- Assess proposals’ compliance with the Federal Acquisition Streamlining Act (FASA).
- Recommend ways to promote commercial product/service usage.
- Within 120 days: Agencies must submit a report to the OMB Director outlining:
- Compliance with FASA.
- Progress toward implementing the executive order’s procurement policies.
- Within 60 days: Contracting officers must review:
