The OSHA Emergency Temporary Standard (ETS) has arrived. The ETS requires employers with at least 100 employees to adopt a vaccination policy that requires employees to be fully vaccinated or submit to at least weekly testing. The ETS further requires employer to provide paid time off to recover from and receive the vaccine, and unvaccinated employees must wear a mask when in contact with coworkers.

OSHA can issue a citation for noncompliance for $13,653 per violation if classified as serious or other than serious, and up to $136,532 if willful or repeated.

While the 5th Circuit Court of Appeals has put a temporary halt to this mandate, it is far from certain what the next steps will be with this sweeping mandate. Join Employment Attorneys Jessica Brown and Lindsay Paulin of the nationally recognized law firm Gibson Dunn as they walk you through this critical issue and answer your questions.

  • How should my company prepare for this mandate?
  • What are my responsibilities as an employer?
  • Do the federal court proceedings impact the federal contractor mandate or Executive Order 14042?
  • What if my state prohibits my firm from checking my employee’s vaccination status?
  • Will the Supreme Court eventually decide this issue?
